A couple who were arrested in Colorado after being sought in the kidnapping of three children whose mother was found dead in a remote area of Gorman were charged with murder and kidnapping, Los Angeles County District Attorney’s officials said Thursday.
Joshua Robertson, 27, and Brittany Humphrey, 22, of the Fresno area, were arrested in Colorado in connection with the death of Kimberly Harvill on Aug. 25. Harvill’s body was found on Aug. 14.
Robertson was scheduled to be arraigned on Thursday, but refused to come out of his cell, DA spokeswoman Jane Robison told KTLA. Prosecutors were expected to set his bail at $2 million.
Humphrey is awaiting extradition from Colorado.
The victim was Humphrey’s stepsister and Robertson is Humphrey’s boyfriend, officials said.
Robertson allegedly shot and killed Harvill and is also being charged with one count of possession of a firearm by a felon with two prior convictions, according to the complaint.
The pair then allegedly kidnapped Harvill’s three children, ages 5, 3 and 2. The children were found safe in Albuquerque on Aug. 24 and the suspects were arrested in Colorado a day later, officials said.
The pair had previously been charged with kidnapping on Aug. 23 and the complaint was amended Thursday to include the murder charges, Robison said. Robertson and Humphrey each face up to life in prison if convicted.
